2. How to File a Takedown Notice
To file a takedown notice with us, your written notice must comply with 17 U.S.C. § 512(c)(3)(A) and include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (a URL is preferred).
- Information reasonably sufficient to permit Hashqix to contact the complaining party, including an address, telephone number, and, if available, an email address.
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Send the notice to [email protected] or by post to the designated-agent address in Section 1.
3. Counter-Notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3). Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Hashqix may be found, and that you will accept service of process from the person who provided the notification or an agent of such person.
Send the counter-notification to [email protected]. Upon receipt, we will forward it to the original complainant and inform them that we may restore the removed material in 10 business days unless they file a court action seeking a restraining order.
4. Repeat-Infringer Policy
In compliance with 17 U.S.C. § 512(i)(1)(A), Hashqix has adopted and reasonably implemented a policy that provides for the termination, in appropriate circumstances, of users and account holders who are repeat infringers. Specifically: an account that receives three (3) substantiated takedown notices within any rolling 12-month period will be permanently terminated. Hashqix may also terminate accounts immediately for a single particularly egregious infringement or any pattern that suggests commercial-scale infringement.
5. False Claims (§ 512(f))
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by Hashqix. Submit takedown notices and counter-notifications in good faith.
